At least 30 families have suffered at the hands of this Melbourne builder

When Sulja Homes didn't begin contruction of Hem Verma's home, months after the contract had been signed and thousands of dollars were paid, Verma approached Consumer Affairs Victoria and VCAT, and received favourable rulings from them. Despite VCAT ordering Sulja Homes to pay Verma $10,500 back, nothing has happened - no monies have been returned and the house construction hasn't even begun. And as SBS Punjabi found out, the Verma family isn't alone at the receiving end of this.
For Hem Verma, it all began in October 2015, when he signed a contract with Sulja Homes in Melbourne, to build a double storey dwelling in Tarniet for a total cost of $263K. He paid $18,337 up front, which included a 5% deposit and $5,200 in upgrades.
By mid-2016, no construction had begun on Verma's block of land - even soil test reports and final plans had not been sent through. Verma approached Consumer Affairs Victoria, who asked Sulja Builders to pay back the $5,200 of upgrades to Verma. Verma was further advised to lodge a case at Victorian Civil and Administrative Tribunal (VCAT) to claim the rest of the money.
In November 2016, Verma managed to strike a settlement with Sulja Homes with the help of a VCAT mediator. The owner of Sulja Homes, Ondrej Sulja was present at the settlement, and "agreed to pay me $10,500 by 25th November 2016, in the presence of his lawyer and a VCAT mediator".
When Verma still hadn’t received the money early this year, he approached VCAT again in February 2017, which enforced the terms of settlement and ordered Sulja Homes to repay Hem Verma.
Ondrej Sulja didn't appear at the hearing on Feb 14 and till date, has not settled the monies, as adjudicated by VCAT.
Hem Verma has spoken to SBS Punjabi about the immense hardship he and at least 30 other families have suffered, because of Sulja Homes. "I'm repaying instalments for the block of land I had bought two years ago, am paying the Council, but after all of this, not even a brick has been laid on my land. Perhaps I'm luckier than those who are living on rent in small houses, with extended families. This has been a nightmare for all of us".
In some cases, construction was begun, but the sites have been deserted for many months now. In Hem Verma's case, contruction didn't even begin.
"My advice to everyone out there is, do your home work before you sign up with any builder. For the sake of saving some money, don't go with a small builder. And make sure your lawyer reads the contract before you sign it - I've now found out from another builder that the contract signed by Sulja with may not even be valid. All the points in the checklist have not been ticked off. So please, take care when you sign a building contract," says Hem Verma.
SBS Punjabi has contacted Sulja Homes numerous times on the phone, but it has gone unanswered. We are still awaiting a response to our email request.

So I'm not really one to speak publicly about personal issues, especially super negative ones, but this time I've been pushed a little too far and it is affecting myself and my family (my fiancé Leah and our 11 month old son) in a really big (and negative) way.
In 2015 I was really proud to lay down a deposit for my first ever block of land to build my first house. Everyone talks about how nobody making under $80k could buy a house, and I was doing it within 25km of Melbourne on around $50k. This was huge for me and I excitedly went to the builder advertising a plan they had for my block on realestate.com.au.
This builder was Sulja Homes. I went and looked through their display home, their book of plans and decided on one and paid my deposit. I signed my contract in July 2015 and paid the rest of my 8% deposit (around $10k).
The land then titled in Feb 2016, which meant it was ready to build on, and I assumed seeing as I'd already signed my contract, paid my deposit, gone through colour selection and had all my finance sorted that getting started on the build was close. I was wrong. Very, very wrong.
For months I called weekly to ask what the hold up was, and kept being told "we aren't far off, a few weeks and we should be right" in the contract it gives them 60 days to obtain all permits and builders warranty/insurance. 6 months passed, and my calls were now multiple times weekly. I was over it. I asked for a refund on my deposits so I could go somewhere else. This was refused.
I was then told that warranty had finally come through in October so they could start soon, but I soon found out this was a massive lie (by the way, this is illegal, they should have had it months ago and they still to this day never got it) which I only found out after multiple phone calls to different insurance companies until I found theirs, as they refused to provide proof.
December rolled around and I had a meeting with the director and the company's new investor Sam. They told me the only way they would build my house is if we increased the contract price by $43k. Yes, $43,000! That was more than 20% of the original price ON TOP! This is also illegal by the way, an increase of such large proportions. I was told after refusing I could finally have my money back, but I have not seen a cent from Sulja.
This was happening to many, many people, and some unfortunate people had (somehow) already had their house started by Sulja homes, and have still not been finished up to a year later, and can't get a release of contract from them.

It has now been over a year since my land was ready to build on, land which I have been paying interest on with no house for over a year because of a Ondrej Sulja (director and owner of Sulja homes).
I have gone to put in a VCAT application to take action, to be told he is not turning up to hearings and it would be a waste of time and money. He has ripped off so many people, and put so many in a tough situation. With an 11 month old, and a partner who works hard to look after him for no income while paying rent AND interest on a block of land for so long, when I should be in a house on that block times are incredibly tough.
To some people $10,000 isn't a lot, but without that money I can't pay a new builder. It takes me nearly 3 months to earn that BEFORE tax. That is a huge chunk of one year. I don't understand how one person can be so despicable, especially with a child of his own, to put someone in a situation like this.
I understand a lot probably didn't read this at all, but for those that have come this far, I thank you for reading what I have to say, and please, if you don't mind, share this so nobody else gets screwed by this man. And if you know anyone who can help in any way with taking action against him, please help me get in touch with them. I want to make sure he Ondrej works in the building industry again, so nobody else has to go through what myself and my family have.
Something like this has a huge impact on ones mental health. I think about it at work, I think about it at home, at events, while with friends and even while doing some of the things that make me happiest, like playing hockey and golf and spending days off with my family. These things help me get through each month, but it's always in the back of my mind, tainting these would-be-perfect moments.
Not a day goes by where I don't think about this, and how to do something about it. I know it isn't my fault, but I can't help but think I've let my son and partner down in a way of colossal proportions. Just like anyone else, all I want is to provide a safe and comfortable place for them to live in, because they deserve it, and while that once seemed so close, it feels like it's starting to get out of reach.
It has now been over a year since my land was ready to build on, land which I have been paying interest on with no house for over a year because of a Ondrej Sulja (director and owner of Sulja homes).
I have gone to put in a VCAT application to take action, to be told he is not turning up to hearings and it would be a waste of time and money. He has ripped off so many people, and put so many in a tough situation. With an 11 month old, and a partner who works hard to look after him for no income while paying rent AND interest on a block of land for so long, when I should be in a house on that block times are incredibly tough.
To some people $10,000 isn't a lot, but without that money I can't pay a new builder. It takes me nearly 3 months to earn that BEFORE tax. That is a huge chunk of one year. I don't understand how one person can be so despicable, especially with a child of his own, to put someone in a situation like this.

If no one wants to protest, maybe take a copy of all complaints made against Ondrei and place it on cars or inconspicuously in church. Those that choose to do nothing and allow Ondrei to get away with a felony are no better. If anyone has any useful information no matter how little pass it on to the authorities to deal with.
